I used your pic with my article

Yesterday The Engine Room received this email:

Hi, I used your pic with my article at suite101.com. - see it at http://personalbudgeting.suite101.com/article.cfm/executors-need-information

That's the entire email, and I'm not sure what to think about it.

On the one hand, I'm pleased to see one of my photos being used elsewhere - and it was nice that the author of the article got in touch to let me know. On the other hand, it would have been nicer if he had asked first - and where's the thank you?

You've got a very polite image thief; he's even credited your blog in the image properties on his site.

I agree it's a bit cheeky, but most people would have just stolen it without permission and not told you about it.

Ah, that's true. Because of my job I'm very aware of media law so I probably have unrealistic expectations when it comes to other people's behaviour.

I'm fairly certain he considers that email his thank-you.

And that he'd take it down if you asked him, though he'd probably wonder why. Most bloggers are used to things being Creative Commons, so I'm sure he thinks he's being very polite about it.

Hi again,
Please allow me to explain. As The Ridger says, I did consider that my comment was a thank you. So let me say, for absolute clarity, "Thank you".
I picked up your image via Google and Flickr and was indeed under the impression that it was available for commercial reuse and free of charge. I acknowleged your ownership of the photo and provided a link back to your blog.
If this is a problem and I have it wrong, I apologise and will, of course, take it down.
In case you can't find my e-mal address via the article or from this comment, it is franfreparker@eircom.net.
I am not yet very web savvy so it is quite possible that I have made a mistake but I am very willing to correct it.
Kind regards,
Frank
BTW here's a link to my original search result where I foound the image: http://images.google.com/images?as_q=Funerals&hl=en&imgtbs=r&btnG=Google+Search&as_epq=&as_oq=&as_eq=&imgtype=&imgsz=&imgw=&imgh=&imgar=&as_filetype=&imgc=&as_sitesearch=&as_rights=%28cc_publicdomain|cc_attribute|cc_sharealike|cc_nonderived%29.-%28cc_noncommercial%29&safe=images&as_st=y

Hi Old Abe

My apologies - I had indeed uploaded the photo to Flickr and set the rights to 'Attribution' and 'Share Alike' but not 'Non-Commercial'.

I was being over-zealous in my original post!
